Lynne Bernabei Provides Opinion on President Trump’s Decision to Dismiss Acting Attorney General Sally Yates

Bernabei & Kabat partner, Lynne Bernabei, was recently interviewed on Federal News Radio regarding her opinion on the President Donald Trump’s recent decision to dismiss Acting Attorney General Sally Yates.

Former-Attorney General Yates publicly refused to defend an executive order which places severe restriction on travel and immigration into the United States. The executive order, signed by President Trump on January 27, 2017, temporarily bans travel of foreign nationals of seven Muslim-majority countries and suspends the United States Refugee Admissions Program (USRAP) for 120 days.

Ms. Bernabei explains that executive branch officials have the right to refuse to defend laws they believe to be unconstitutional or otherwise illegal.

She also discusses the State Department’s employee opposition to the above executive order, and the challenges that those employees may face for having raised their concerns.
