Former Attorney General Passed Up For Interviews, Alleges Age Discrimination

Bernabei & Wachtel represents a former state Attorney General of North Dakota who has a long and distinguished career in both government and private practice, and has taught as an adjunct law professor. Based on his experience, he decided to apply for tenure-track positions at law schools, but was consistently turned down for interviews at the annual hiring session of the American Association of Law Schools (AALS).

He filed charges of discrimination with the EEOC, alleging age discrimination, on the grounds that the law schools interviewed and hired younger, less-experienced candidates. After the EEOC issued a right to sue letter, Bernabei & Wachtel filed a complaint in the U.S. District Court for the District of Columbia, against one of these schools, Michigan State University.

His complaint alleges that this law school hired three less-experienced candidates instead of hiring him, even though he had specific experience in one of the fields (tax law) for which the law school was recruiting.
