In a case brought under the Rehabilitation Act, the Equal Employment Opportunity Commission issued a significant ruling in favor of a federal job applicant represented by David Wachtel of the Bernabei & Kabat Law Firm. EEOC ruled that the Navy lacked evidence to support its conclusion that hiring the Complainant created likely and imminent risk of harm. EEOC ordered the Navy to give Complainant the job, pay him back pay for the six years since he applied for the job, pay compensatory damages in an amount to be determined, and pay Complainant’s attorney’s fees. The EEOC also ordered the Navy to train the supervisors responsible and to consider disciplining them. The case began with the support of the Washington, D.C. law firm of Rose & Rose, where Mr. Kabat was affiliated between 1993 and 2005.
