Bernabei & Kabat represents Joe Zorek, a long-time and dedicated pharmacist at a CVS store in Harrisburg, Pennsylvania. Mr. Zorek protested the actions by senior managers to cut the pharmacy staff in order to increase profits, since that meant the remaining staff had to work much longer hours, and increased the error rate in filling prescriptions under time pressure. He also complained that the company failed to accommodate his disability, since he could have continued to work as a pharmacist with a reasonable accommodation that the company refused to allow. The Wall Street Journal, Philadelphia Inquirer, Penn Live/Patriot News, and The Pharmacist Activist all covered his lawsuit, recently filed in federal court.
