Kristen Sinisi Contributes Article to Law360 on Facebook’s Targeted Advertising

Bernabei & Kabat senior associate, Kristen Sinisi, wrote an article for Law360regarding Facebook’s targeted-advertising platform which is under scrutiny because of its option to exclude users from employment ads based on their sex, potentially in violation of Title VII and analogous state and local laws. Following the enactment of Title VII, the EEOC clarified in 1968 that sex-segregated employment ads constituted unlawful discrimination. Although that issue has remained relatively well-settled for the last half-century, Facebook’s advertising platform has resurrected it. On September 18, 2018, Plaintiffs filed a class-action EEOC charge, challenging employers and employment agencies which used the platform to exclude Facebook users from job ads based on their sex, as well as Facebook for contributing to the development of the discriminatory material and enabling the unlawful practice.
