Lynne Bernabei Quoted in the National Law Journal

Lynne Bernabei was quoted in the National Law Journal (Oct. 29, 2007), in the article “Employers scoring in whistleblower actions.” Ms. Bernabei discusses how the U.S. Department of Labor is interpreting and applying the Sarbanes-Oxley whistleblower statute too narrowly. She notes that the agency is placing too high a burden of proof on employees, either requiring them to prove an actual violation, or proof of specific fraud on the shareholders, neither of which is required under Sarbanes-Oxley.
