Bernabei & Kabat has joined with the Lawyers Committee for Civil Rights under Law to intervene on behalf of students in the affirmative action case recently brought against the University of Texas by the Students for Fair Admissions (SFFA). That lawsuit seeks to end affirmative action in undergraduate admissions at the University of Texas. The students who are intervening are those who oppose these efforts, because they and their fellow students have benefited from having a diverse student body at Texas, and they seek to uphold the continued use of race-conscious admissions at Texas. Although the U.S. Supreme Court previously upheld the affirmative action program at Texas, the SFFA has now sued under state law. There are similar lawsuits pending against both Harvard (now on appeal) and the University of North Carolina.
